In a statement, Empower said it has &#8220;already remediated many of the issues outlined in the Warning Letter,&#8221; adding that it will &#8220;continue to work cooperatively with the agency to ensure patient access to quality compounded drug products.&#8221;\u00a0<\/p>\n<p>Empower openly advertises two of the <a href=\"https:\/\/www.empowerpharmacy.com\/compound-medication\/weight-management\/\" target=\"_blank\" rel=\"noopener\">most<\/a> <a href=\"https:\/\/www.empowerpharmacy.com\/compounding-pharmacy\/tirzepatide-niacinamide-injection\/\" target=\"_blank\" rel=\"noopener\">popular<\/a> medications on its website, which are available to healthcare providers and not directly to consumers.<em>\u00a0<\/em><\/p>\n<p>Here&#8217;s what to know:\u00a0<\/p>\n<h2>What are compounding pharmacies, and how are they able to make cheaper versions of blockbuster weight-loss drugs?<\/h2>\n<p>Compounding pharmacies have traditionally custom-tailored medications for individual patients, such as making a liquid solution for someone who can&#8217;t swallow a pill. Regulators inspect their facilities but don&#8217;t review the medications they make. Because of this, the FDA says it can&#8217;t offer the same <a href=\"https:\/\/www.fda.gov\/drugs\/human-drug-compounding\/compounding-and-fda-questions-and-answers\" target=\"_blank\" rel=\"noopener\">safety assurances<\/a> as drugs that go through its rigorous approval process.<\/p>\n<p>With the frenzy ignited by <a href=\"https:\/\/www.youtube.com\/watch?v=xt9l6Xgsl88\" target=\"_blank\" rel=\"noopener\">GLP-1 weight-loss drugs<\/a>, compounding pharmacies have found a new opportunity. FDA regulations allow them to make copies of brand-name drugs when the agency <a href=\"https:\/\/www.fda.gov\/drugs\/human-drug-compounding\/compounding-when-drugs-are-fdas-drug-shortages-list\" target=\"_blank\" rel=\"noopener\">declares a shortage<\/a>. So when the FDA determined that Novo Nordisk and Eli Lilly couldn&#8217;t keep up with demand for their appetite-suppressing drugs in 2022, many compounders <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/fda-approved-alternatives-ozempic-wegovy-mounjaro-compounding-pharmacies\/\" data-invalid-url-rewritten-http=\"\">jumped at the chance<\/a><\/span> to make their own versions, drawing millions of patients with much cheaper prices.<\/p>\n<h2>How is it that compounding pharmacies can still make versions of these drugs?<\/h2>\n<p>This is where things get contentious. The FDA declared an <span class=\"link\"><a href=\"https:\/\/www.cbsnews.com\/news\/fda-declares-end-to-wegovy-and-ozempic-shortage\/\" data-invalid-url-rewritten-http=\"\">end to the shortage<\/a><\/span> in 2025. Federally licensed compounding pharmacies \u2014 which are permitted to make larger quantities of medications and have to comply with more exacting standards \u2014 have largely <a href=\"https:\/\/www.accessdata.fda.gov\/scripts\/cder\/outsourcingfacility\/index.cfm\" target=\"_blank\" rel=\"noopener\">stopped making copies<\/a> of Eli Lilly&#8217;s tirzepatide (marketed as Zepbound and Mounjaro) and Novo&#8217;s semaglutide (sold as Wegovy and Ozempic). But smaller, state-licensed pharmacies have continued to make versions of these drugs, citing an <a href=\"https:\/\/www.fda.gov\/media\/98973\/download\" target=\"_blank\" rel=\"noopener\">FDA policy<\/a> that allows them to tweak an approved drug \u2014 altering the dosage, or combining it with a vitamin \u2014 when a licensed medical professional says the change will make a &#8220;significant difference&#8221; for an individual patient.<\/p>\n<p>Eli Lilly and Novo have loudly objected to this practice in public statements and lawsuits. Eli Lilly is currently <a href=\"https:\/\/www.courtlistener.com\/docket\/70920996\/1\/eli-lilly-and-company-v-empower-clinic-services-llc\/\" target=\"_blank\" rel=\"noopener\">suing Empower<\/a>, claiming the pharmacy&#8217;s &#8220;practice of marketing (sham) &#8216;personalized&#8217; products is deceptive, because in fact, Empower is mass-manufacturing standardized knockoffs of Lilly&#8217;s commercially available and FDA-approved medicines.&#8221;\u00a0<\/p>\n<p>Empower <a href=\"https:\/\/www.courtlistener.com\/docket\/70920996\/81\/eli-lilly-and-company-v-empower-clinic-services-llc\/\" target=\"_blank\" rel=\"noopener\">denies this<\/a> in court documents, and the litigation is ongoing.<\/p>\n<h2>What makes this enforcement action from the FDA significant?<\/h2>\n<p>This marks the first time the FDA has stepped into the debate over where the narrow carve-out for personalized drugs ends and mass production begins.\u00a0<\/p>\n<p>After an inspection in November 2025, the FDA determined that Empower was essentially using a pretext for copying the FDA-approved drugs on a large scale, according to its <a href=\"https:\/\/www.fda.gov\/inspections-compliance-enforcement-and-criminal-investigations\/warning-letters\/empower-clinic-services-llc-dba-empower-pharmacy-738238-09182026\" target=\"_blank\" rel=\"noopener\">warning letter<\/a>.<\/p>\n<p>The FDA cited three main pieces of evidence:<\/p>\n<ol>\n<li>Orders that didn&#8217;t include a prescriber saying Empower&#8217;s version would make a &#8220;significant difference&#8221; from the FDA-approved version.<\/li>\n<li>Other orders where the prescriber&#8217;s rationale &#8220;appear[s] to be repeated verbatim.&#8221;<\/li>\n<li>The sheer volume Empower was making (exact amounts were redacted).<\/li>\n<\/ol>\n<p>Scott Brunner, CEO of Alliance for Pharmacy Compounding, said that the FDA&#8217;s warning wasn&#8217;t about the volume alone, but the lack of documentation to prove that Empower was appropriately making the drug for individual patient needs.<\/p>\n<h2>Will the FDA action affect whether compounded GLP-1 drugs are available to consumers?<\/h2>\n<p>&#8220;The FDA is possibly marking a line in the sand,&#8221; said Darshan Kulkarni, founding partner of the Kulkarni Law Firm and an expert in healthcare and pharmacy law.
